Die Frage des Löschens von E-Mails aus dem Archiv ist nach unseren Informationen rechtlich umstritten. Aus Sicht der DSGVO ist nachvollziehbar, dass das Löschen von bestimmten Mails aus dem Archiv möglich sein muss. Aus der Sicht der GoBD sind keine Löschverpflichtungen definiert. Die Aufbewahrungsfristen der archivierten Mails sind durch das Handelsgesetzbuch (HGB) und die Abgabenordnung (AO) definiert, die jedoch ebenfalls keine Aussage über Löschverpflichtungen enthalten.
Würde man einer Löschverpflichtung nach DSGVO nachkommen, würde das unweigerlich die Gesamtkonsistenz des Archivs beeinflussen, was mit der GoBD kollidiert.

For us as a manufacturer, the question of deleting emails and its associated consequences is naturally of great interest. From a technical perspective, it's easy for us to provide a deletion function in Benno MailArchiv. However, deletion raises questions regarding legal aspects and implications. Therefore, we regularly seek legal advice on this matter. As of mid-2020, for example, it appeared that there was no legally sound solution or legally binding interpretation regarding the deletion of emails from the mail archive. From a legal standpoint, there is apparently still insufficient clarity or binding agreement on which law takes precedence over the other: Does the GDPR supersede the GoBD (Principles for the Proper Keeping and Use of Books, Records and Documents in Electronic Form and for Data Access) with regard to deletion, or do the GoBD take precedence over the GDPR in this respect? On the one hand, we have customers who insist that the GDPR absolutely takes precedence over the GoBD. Other customers, however, see it exactly the other way around. We have drawn our conclusions from this and have positioned ourselves as follows:

• As long as there is no legally binding solution or clear and unambiguous legal opinion on the deletion of emails, we will allow the deletion of emails in Benno in the manner described above.
• We neither advise our customers to delete emails (a sure violation of GoBD regarding the consistency of the archive), nor do we advise them not to delete emails (a possible sure violation of GDPR).
• It is the sole responsibility of the end customer to decide which of the two methods he chooses regarding his emails.

In the discussion about deleting emails, the question of excluding emails from archiving should not be overlooked. It is certainly possible to permanently exclude certain emails from archiving. For example, emails from specific addresses like bewerbungen@…, betriebsrat@…, etc., can be excluded from archiving, preventing them from ever being archived and thus eliminating the question of potential deletion. However, it is crucial to note that this could lead to incompleteness in the context of the German Principles for the Proper Keeping and Use of Books, Records and Documents in Electronic Form (GoBD). This might be justifiable and demonstrable to the tax authorities. Within the framework of the (GoBD-mandated) procedural documentation, the situation could be explicitly documented, justified, and described, potentially reducing the potential for problems. Regardless of whether such scenarios are implemented, the tax auditor or the external auditor will ultimately have to accept, criticize, or reject the result.
